The gambling landscape in the US continues to undergo significant changes as California moves to ban sweepstakes casinos.

Assembly Bill 831, which aims to prohibit these casinos, is gaining momentum, receiving unanimous approval from the Senate Governmental Organization Committee on July 10th. If passed, the Bill will impact operators and marketers in the region.

As highlighted by digital marketing and media specialists, AdsMaman, AB831 extends its reach beyond the operators, targeting the entire ecosystem involved in sweepstakes casinos. Payment processors, software vendors and even celebrity endorsers could face penalties, including fines of $25,000 or up to one year in jail.

The Bill’s broad definition of sweepstakes raises concerns about its effect on legitimate promotional activities.

The push for the ban is led by the California Nations Indian Gaming Association (CNIGA) and other tribal gaming stakeholders. They argue that sweepstakes casinos threaten the exclusivity of tribal gaming, which is constitutionally protected in California. Notably, commercial operators like FanDuel and DraftKings also support the Bill, highlighting a unique alliance aimed at safeguarding the established market.

Opponents, including the Social Gaming Leadership Alliance (SGLA), claim the Bill is more about limiting competition than protecting consumers. They say that existing self-regulation in sweepstakes platforms and mention over 20,000 public comments opposing the Bill, indicating significant public dissent.

Despite such opposition, momentum for the Bill is growing, with Montana already implementing a similar ban.

For iGaming marketers, AB831 represents a tightening of the advertising landscape in California. This includes reduced platform availability for campaigns, increased scrutiny over affiliate and celebrity deals and greater risks for advertisers promoting sweepstakes.

Brands are exploring alternative campaign strategies that offer flexibility beyond traditional advertising channels. Solutions like AdsMaman’s tailored media buying systems are becoming crucial for navigating these challenges.

As California’s potential ban looms, it signals a broader marketing shift that could influence legislation in other major states. And for campaigns dependent on exposure in sensitive regions, adapting to these changes is essential.
